TERMS OF USE

Welcome to Volunteerly! These terms applies for your use of the Lokalfrivillig platform.

By creating a user profile you accept these terms.

1. Who is Volunteerly?

Volunteerly ApS, CVR-nr. 45475719, operates the Lokalfrivillig platform, where users and organisers can share and register for activities related to being a volunteer.

2. Who can use the platform?
  • You have to be at least 13 years old.
  • You have to create a personal profile with correct information.
  • You can not have an anonymous user, as your identity is important when you participate in an event as a volunteer.
  • You can terminate your user profile by sending an email to info@lokalfrivillig.dk.
3. How does Volunteerly work?
  • When you have created a user profile, you can sign up for events that matches your interests and local area.
  • Organisers expect, that you show up to the events where you have a shift. If you cannot participate, you have to deregister either through the platform or directly to the organiser.
  • You are not allowed to provide false information or misuse the platform in any way.

If you misuse the platform, Volunteerly has the right to:

  • Suspend or delete the user profile.
  • Remove any illegal or offensive content.
4. Organisers and responsibilities
  • The term “Organisers” refers to organisations or associations that offer events.
  • Organisers has to have a separate agreement with Volunteerly to be able to create events.
  • When you sign up for an event, your user is linked with the organiser in question.
  • When your data is processed in relation to an organiser, it is according to the joint data processing agreement that Volunteerly has with every organiser. Meaning that both parties has responsibility for ensuring that your information is processed legally and safely.
  • The organiser is solely responsible for the actual events, contact and eventual selection of volunteers. Volunteerly is not an employer in this respect, and cannot be held accountable for the contents, the execution or safety of the event.
  • Volunteerlys role is to facilitate the contact between the user and the organiser, and to make relevant administrative tools available.
5. Personal information and data protection
  • We process your information to make the platforms function available to you. It happens in accordance with the applicable privacy policy and GDPR/data protection legislation in force at any time.
  • The privacy policy states, which informations we process, why we do it, and which rights you have as a registered user.
  • When you create a profile, you agree to our processing of information as described in the privacy policy.

When you participate in events from an organiser, there will always be an agreement on how Volunteerly and the organiser process your data jointly. This means that both parties cooperate on the data processing, and that we have a joint liability to comply to the rights you have according to GDPR.

6. Communication and Consent
  • We will send you messages/notifications about the events you have registered for as part of the service.
  • When you link your user profile with an organiser, you will receive relevant messages, such as reminders about events you have registered for, as well as information about new activities with the organiser where you may volunteer. This communication is a natural part of your connection and does not require separate consent. You can withdraw your connection to an organiser at any time through your settings.
  • If the organiser or the platform wishes to send you marketing, such as offers for guests or from partners, we will ask for your separate consent.
7. Limitation of Liability

Volunteerly only facilitates the contact between users and organisers and make the platforms administrative tools available to the organiser. We are not liable for the contents, execution, or safety of any events.

Volunteerly cannot be held accountable for any losses, damages or incidents in relation an event or the participation in an event. Our responsibility is in all cases limited to cases where we have acted intentionally or with gross negligence, and we are never accountable for indirect losses, including operating losses or lost earnings.

This liability limitation does not affect Volunteerlys liability in relation to current data protection legislation or other mandatory legislation.

8. Changes to the Terms
  • Volunteerly can change this terms with 14 days notice.
  • You will be informed of changes via the platform and e-mail. Continuous use after the changes has taken effect, mean that you accept the new terms.
9. Governing Law and Disputes

These terms and conditions are subject to Danish law.

Any disputes shall be settled by the courts of the municipality where Volunteerly ApS has its registered office.

If you are a consumer, you may always bring a case before the courts in your own jurisdiction.

1. Formål og baggrund

Denne aftale fastlægger fordelingen af ansvar, når Volunteerly ApS og Arrangøren behandler personoplysninger i fællesskab i forbindelse med brug af platformen Volunteerly.dk.

Volunteerly og Arrangøren har fælles dataansvar, fordi arrangøren får adgang til Volunteerlys brugerbase af frivillige via platformen.

  • Volunteerly er ansvarlig for driften af platformen og behandlingen af brugernes profiler.
  • Arrangøren er ansvarlig for behandlingen i forbindelse med egne arrangementer og medlemskaber.
  • Det fælles ansvar knytter sig til tilknytningen mellem bruger og arrangør, hvor oplysninger deles for at muliggøre tilmelding og medlemsaktiviteter.
2. Roller og ansvar

Volunteerly ApS:

  • Drift, sikkerhed og udvikling af platformen.
  • Oprettelse og vedligehold af brugerprofiler.
  • Understøttelse af kommunikation mellem arrangører og frivillige.

Arrangøren:

  • Planlægning og afvikling af arrangementer.
  • Kommunikation med frivillige og medlemmer.
  • Dokumentation og opfølgning i forbindelse med arrangementer og medlemskaber.

Begge parter er ansvarlige for at behandle oplysninger lovligt og efter GDPR.

3. De registreredes rettigheder
  • Volunteerly er den primære kontakt for brugere, der ønsker at udøve deres rettigheder (indsigt, rettelse, sletning mv.).
  • Hvis arrangøren modtager en henvendelse om at en registreret på Volunteerly platformen ønsker at udøve deres rettigheder, sendes denne straks videre til Volunteerly.
  • Hvis en henvendelse vedrører oplysninger, som arrangøren alene har behandlet (fx medlemsdata eller lokalt gemte oplysninger), skal arrangøren bistå Volunteerly med at besvare henvendelsen.
  • Parterne forpligter sig til at samarbejde, så brugernes rettigheder kan udøves fuldt ud.
3a. Oplysningspligt
  • Volunteerly opfylder oplysningspligten over for de registrerede for de oplysninger, der indsamles i forbindelse med oprettelse og brug af en brugerprofil på platformen. Dette sker gennem Volunteerlys privatlivspolitik.
  • Arrangøren opfylder oplysningspligten over for brugerne for de oplysninger, der behandles i forbindelse med egne arrangementer og medlemskaber. Dette sker gennem arrangørens privatlivspolitik.
  • Parterne forpligter sig til at sikre, at brugerne altid kan få klar og let tilgængelig information om, hvordan deres oplysninger behandles, og hvordan de kan udøve deres rettighede
4. Sikkerhed og brud
  • Begge parter skal sikre passende tekniske og organisatoriske foranstaltninger.
  • Hvis en part bliver opmærksom på et brud på persondatasikkerheden, skal den straks informere den anden part og samarbejde om at håndtere sagen og eventuel indberetning til Datatilsynet.
5. Overførsel af personoplysninger til tredjelande eller internationale organisationer.

Ingen af parterne er berettiget til at overføre personoplysninger til tredjelande eller internationale organisationer, med mindre andet er aftalt I den eventuelt selvstændige databehandleraftale mellem de dataansvarlige.

6. Ikrafttræden og varighed
  • Aftalen træder i kraft, når Arrangøren accepterer den digitalt via Volunteerly-platformen.
  • Aftalen gælder, så længe arrangøren bruger platformen.
7. Klager
  • Hvis en bruger klager over behandlingen af personoplysninger, håndteres klagen af den part, som klagen vedrører.
  • Volunteerly kan i nødvendigt omfang videresende dele af en klage til arrangøren, hvis sagen vedrører arrangørens behandling.
  • Brugeren orienteres altid om, hvilken part der behandler klagen, og kan klage til Datatilsynet (www.datatilsynet.dk).
8. Ændringer
  • Volunteerly kan foretage mindre ændringer i denne aftale (fx kontaktoplysninger eller sproglige præciseringer) med 30 dages varsel.
  • Væsentlige ændringer, som påvirker arrangørens rettigheder eller forpligtelser, kræver arrangørens accept.
  • Hvis arrangøren ikke ønsker at acceptere væsentlige ændringer, kan samarbejdet ophøre.

3. Hvad bruger vi dine oplysninger til?

Vi bruger dine oplysninger til at:

  • Planlægge og koordinere arrangementer, du har tilmeldt dig
  • Kommunikere med dig før, under og efter arrangementet
  • Dokumentere deltagelse af hensyn til sikkerhed eller myndighedskrav

Når du tilknytter dig vores organisation (fx som frivillig eller medlem), kan vi sende dig information om vores nye arrangementer og frivilligopgaver. Dette er en naturlig del af din tilknytning og kræver ikke særskilt samtykke.

Hvis vi ønsker at sende dig markedsføring, fx tilbud til gæster eller fra samarbejdspartnere, vil vi bede om dit særskilte samtykke.

4. Hvad er det lovlige grundlag for det?

Vi behandler dine oplysninger, fordi:

  • det er nødvendigt for, at du kan deltage i arrangementet
  • vi har en legitim interesse i at organisere og dokumentere frivillige indsatser
  • vi kan være forpligtet til det af lovgivning
  • markedsføring sker kun, hvis du har givet særskilt samtykke
5. Hvor længe gemmer vi dine oplysninger?

Vi opbevarer personoplysninger I forbindelse med et konkret arrangement i op til 12 måneder efter arrangementets afholdelse.

Hvis du er medlem, opbevares dine oplysninger, så længe dit medlemskab består.

6. Hvem deler vi oplysninger med?

Vi deler kun oplysninger med relevante personer i vores organisation og med Volunteerly som fælles dataansvarlig. Vi videregiver ikke oplysninger til andre, medmindre det er nødvendigt af hensyn til afvikling eller sikkerhed.

7. Dine rettigheder

Du har ret til:

  • At få indsigt i de oplysninger, vi har om dig
  • At få rettet eller slettet dine oplysninger
  • At trække et evt. samtykke tilbage
  • At klage til Datatilsynet via datatilsynet.dk

9. Ændringer

4. What is the legal basis?

We process your information because:

  • it is necessary for you to participate in the event
  • we have a legitimate interest in organising and documenting volunteering activities
  • we may be required to do so by law
  • marketing only takes place if you have given separate consent
5. How long do we keep your information?

We store personal data related to a specific event for up to 12 months after the event has taken place.

If you are a member, we keep your information for as long as your membership continues.

6. Who do we share your information with?

We only share information with relevant people in our organisation and with Volunteerly as joint data controller. We do not disclose your information to others unless it is necessary for the execution or safety of the event.

7. Your rights

You have the right to:

  • Access the information we hold about you
  • Have your information corrected or deleted
  • Withdraw any consent you may have given
  • Lodge a complaint with the Danish Data Protection Agency via www.datatilsynet.dk

You can contact both us and Volunteerly to exercise your rights.

9. Changes
